Terms of Service

Please read these Terms of Service ("Terms") carefully. They constitute a legally binding agreement between you ("you" or "user") and YourPylon ("YourPylon," "we," "our," or "us"), operator of yourpylon.com (the "Site") and the YourPylon electricity management service (the "Service").

BY ACCESSING THE SITE, CREATING AN ACCOUNT, OR USING THE SERVICE IN ANY WAY, YOU AGREE TO THESE TERMS IN FULL. If you do not agree, you must not use the Site or Service.

If you are registering a utility account that belongs to another person, you represent and warrant that you have full legal authority to bind that person and to authorize supplier switching on their account.

1. Description of Service

1.1 What YourPylon Does

YourPylon is a free residential electricity management service. When you register, YourPylon identifies available electricity suppliers in your area, enrolls you with the supplier offering the best available rate, and thereafter monitors supplier rates on your behalf. When a better rate becomes available at the appropriate time — subject to your existing contract terms — YourPylon automatically re-enrolls you with the lower-cost supplier without any action required from you.

1.2 YourPylon's Role

YourPylon acts as your authorized agent solely for the purpose of electricity supplier selection and enrollment. YourPylon is not an electricity supplier, utility, or energy retailer. YourPylon does not generate, transmit, or deliver electricity. Your electricity delivery will continue uninterrupted through your local utility regardless of which supplier you are enrolled with. Your relationship with your supplier is governed exclusively by your supply contract with that supplier, not by these Terms.

1.3 How YourPylon Is Compensated

The Service is entirely free to you. YourPylon receives commissions paid by electricity suppliers upon residential customer enrollment. These commissions are part of the suppliers' standard market pricing and do not result in any additional charge to you. YourPylon's selection logic always targets the lowest available rate for you, irrespective of commission amounts.

1.4 No Guarantee of Availability

YourPylon currently operates in deregulated residential electricity markets in Illinois, Ohio, Pennsylvania, New Jersey, New York, Massachusetts, Rhode Island, New Hampshire, Maine, Delaware, Texas, Connecticut, and the District of Columbia. We reserve the right to modify supported markets at any time without notice. Availability of the Service in any given area is subject to PowerKiosk platform support and applicable state regulations.

2. Eligibility and Account Registration

2.1 Eligibility

To use the Service you must: (a) be at least 18 years of age; (b) be a residential electricity customer in a supported deregulated market; (c) be the account holder of record on the utility account you register, or be expressly authorized by the account holder to manage that account and authorize supplier switching; and (d) provide accurate, current, and complete information during and after registration.

2.2 Account Creation

You create an account by completing the registration flow on the Site. You must provide a valid personal email address and a working phone number. You are solely responsible for the accuracy of all information you provide and for updating it promptly if it changes.

2.3 One Account Per Utility Account

Each utility account may be registered only once. Duplicate registrations of the same utility account are prohibited.

2.4 Account Security

YourPylon uses magic link authentication. Dashboard access is provided via a single-use, time-limited link sent to your registered email. You are solely responsible for the security of your email account. YourPylon is not liable for any unauthorized access to your account resulting from your failure to secure your email account or from your sharing of a magic link.

3. Letter of Authorization and Agency

3.1 Authorization Required

Enrollment in the Service requires you to execute a Letter of Authorization (LOA). By signing the LOA, you authorize YourPylon to:

  • Shop for electricity supply rates on your behalf.
  • Select the electricity supplier offering the best available rate for your location and utility.
  • Submit enrollment applications to suppliers on your behalf.
  • Manage your supply contract lifecycle, including re-enrollment at or before contract expiry.

3.2 Scope and Duration

Your LOA covers all current and future automatic switches performed by YourPylon for the duration of your enrollment. You do not sign a new LOA each time YourPylon switches your supplier. By executing the LOA, you expressly acknowledge and accept that YourPylon may switch your electricity supplier multiple times, at its discretion, in pursuit of the best available rate.

3.3 Your Responsibility for Accurate Information

You are solely responsible for providing accurate utility account information, contract status, and contract end date at registration and whenever these change. YourPylon makes enrollment decisions based entirely on information you provide. Enrollment failures, supplier rejections, or early termination fees resulting from inaccurate, incomplete, or outdated information you provided are your sole responsibility. YourPylon bears no liability for consequences arising from user-provided inaccuracies.

3.4 Revoking Authorization

You may revoke your LOA at any time by submitting a written revocation to support@yourpylon.com. Revocation takes effect upon YourPylon's written confirmation. Pausing automatic switching in your dashboard suspends monitoring activity but does not revoke the LOA; a formal written revocation is required to fully terminate the agency relationship.

4. Automatic Switching

4.1 How It Works

YourPylon's automated system runs daily. For users in states with residential early termination fee prohibitions (currently Connecticut and Illinois), the system may switch your supplier mid-contract if a materially better rate is available. For all other states, the system submits new enrollment in the calendar month before your existing contract expires, so the new contract activates at your next meter read date, avoiding ETF exposure.

4.2 No Guarantee of Continuous Switching or Savings

YourPylon does not guarantee that a better rate will always be available. At times, all available supplier rates may equal or exceed your utility's default rate, in which case no switch will occur. YourPylon does not guarantee savings on your electricity bill. Rates may increase after enrollment. Total electricity costs depend on delivery charges and other factors entirely outside YourPylon's control. YourPylon bears no liability for any electricity costs you incur.

4.3 Supplier Rejections

Suppliers may reject enrollment applications for reasons entirely outside YourPylon's control, including credit requirements, service territory limitations, or supplier eligibility criteria. YourPylon is not liable for supplier rejections or for any resulting gap in supplier coverage.

4.4 Pausing and Resuming

You may pause automatic switching at any time via your dashboard. When paused, YourPylon will not monitor rates or submit enrollments. Your existing supplier contract remains in place. You may re-enable at any time.

4.5 Early Termination Fees

YourPylon's system is designed to avoid exposing you to early termination fees by timing enrollment submissions to the month before your contract expires. However, if you provide an incorrect contract end date, YourPylon may submit an enrollment at a time that triggers an ETF from your existing supplier. YourPylon is not liable for any ETFs, penalties, or charges assessed by a supplier as a result of a switch, regardless of the cause.

5. User Responsibilities and Prohibited Conduct

5.1 Accuracy

You represent and warrant that all information you provide — including your name, utility account number, service address, contract status, and contract end date — is accurate, complete, and current. You agree to update this information promptly if it changes.

5.2 Account Authority

You represent and warrant that you are the utility account holder of record or are expressly authorized by the account holder to register the account and authorize supplier changes.

5.3 Prohibited Use

You may not use the Site or Service to: (a) provide false, misleading, or unauthorized information; (b) register utility accounts belonging to other persons without explicit authorization from the account holder; (c) circumvent or interfere with any security or access control feature; (d) scrape, crawl, or systematically extract data from the Site by automated means; (e) use the Service for any unlawful purpose or in violation of any applicable regulation; (f) take any action that imposes an unreasonable or disproportionate load on the Site's infrastructure; or (g) attempt to reverse-engineer, decompile, or otherwise extract the source code of any portion of the Service.

6. Intellectual Property

6.1 Ownership

The Site and all content and materials on it — including text, graphics, logos, software, user interface design, and underlying code — are owned by or licensed to YourPylon and are protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in any YourPylon intellectual property.

6.2 Limited License

Subject to these Terms, YourPylon grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site and Service solely for managing your own residential electricity account. Any use beyond this scope requires YourPylon's prior written consent.

6.3 Feedback

If you submit feedback, suggestions, or ideas to YourPylon, you grant YourPylon a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate that feedback into the Service or any other product, without any obligation or compensation to you.

7. Disclaimers of Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOURPYLON EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
  • ANY WARRANTY THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
  • ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY RATE DATA, SUPPLIER INFORMATION, OR OTHER CONTENT PROVIDED THROUGH THE SERVICE.
  • ANY WARRANTY THAT USE OF THE SERVICE WILL RESULT IN SAVINGS OR THAT ANY ENROLLED RATE WILL REMAIN COMPETITIVE FOR THE DURATION OF ANY CONTRACT.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

YOURPYLON IS NOT RESPONSIBLE FOR THE ACTS, OMISSIONS, RATE CHANGES, BILLING PRACTICES, OR SERVICE QUALITY OF ANY ELECTRICITY SUPPLIER OR UTILITY. YOUR RELATIONSHIP WITH YOUR SUPPLIER IS SOLELY BETWEEN YOU AND THAT SUPPLIER.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(a) IN NO EVENT WILL YOURPYLON, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF SAVINGS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, SYSTEM FAILURE, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, EVEN IF YOURPYLON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) IN NO EVENT WILL YOURPYLON'S TOTAL CUMULATIVE LIABILITY TO YOU ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE FORM OF ACTION OR BASIS OF THE CLAIM — WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE — EXCEED ONE DOLLAR ($1.00).

(c) THIS LIMITATION REFLECTS A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND YOURPYLON. THE SERVICE IS PROVIDED FREE OF CHARGE, AND THIS LIABILITY CAP IS A REASONABLE ALLOCATION OF RISK GIVEN THE NATURE OF THE SERVICE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DAMAGE EXCLUSIONS OR LIABILITY LIMITATIONS. IN SUCH JURISDICTIONS, YOURPYLON'S LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

Nothing in these Terms limits YourPylon's liability for fraud, willful misconduct, or any liability that cannot be limited or excluded by law.

9. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend (at YourPylon's option), and hold harmless YourPylon and its owners, officers, employees, agents, and service providers from and against any and all third-party claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Site or Service; (b) your violation of any provision of these Terms; (c) your breach of any representation or warranty herein; (d) any inaccurate, false, or unauthorized information you provided; (e) your violation of any law or the rights of any third party; or (f) any dispute between you and an electricity supplier or utility.

YourPylon reserves the right to assume exclusive control of any matter subject to indemnification by you, at its own expense. You agree to cooperate fully with YourPylon's defense of any such claim and not to settle any such claim without YourPylon's prior written consent.

10. Dispute Resolution

10.1 Informal Resolution First

Before initiating any formal proceeding, you agree to contact YourPylon at support@yourpylon.com and attempt to resolve the dispute informally. YourPylon will attempt to resolve the dispute within 30 days of receiving your notice. If the dispute is not resolved within 60 days of your initial notice, either party may pursue the remedies below.

10.2 Binding Individual Arbitration

EXCEPT AS PROVIDED IN SECTION 10.4, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE — INCLUDING THE VALIDITY, INTERPRETATION, BREACH, OR TERMINATION THEREOF — SHALL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING ARBITRATION, NOT IN COURT. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at www.adr.org). The arbitrator shall apply Illinois law. The arbitration shall be conducted in Illinois or, at YourPylon's election, by telephone or videoconference. The arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

10.3 Class Action and Jury Trial Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND YOURPYLON EACH WAIVE THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY. YOU ALSO WAIVE ANY RIGHT TO A JURY TRIAL. If a court finds the class action waiver unenforceable for a particular claim, that claim must be severed from arbitration and litigated in court on an individual basis; all other claims remain subject to arbitration.

10.4 Opt-Out

You may opt out of the arbitration provision in Section 10.2 by sending a written opt-out notice to support@yourpylon.com within 30 days of the date you first agreed to these Terms. The notice must include your name, email address, and a clear statement opting out of arbitration. Opting out does not affect any other provision of these Terms.

10.5 Exceptions

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims eligible for small claims court may be brought there.

10.6 Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law rules. To the extent court proceedings are permitted under these Terms, you consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Illinois.

10.7 Time Limitation on Claims

ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE MUST BE BROUGHT WITHIN ONE (1) YEAR OF THE DATE THE CLAIM AROSE, OR IT IS PERMANENTLY BARRED. THIS APPLIES REGARDLESS OF ANY STATUTE OF LIMITATIONS TO THE CONTRARY.

11. Termination

11.1 Termination by You

You may close your account at any time by contacting support@yourpylon.com. Upon termination, YourPylon will cease automatic monitoring and will not submit further enrollment applications on your behalf. Any existing supply contract with an enrolled supplier remains in effect until its natural expiration; canceling your YourPylon account does not cancel your supplier contract. You must contact your supplier directly to cancel a supply contract.

11.2 Termination by YourPylon

YourPylon may suspend or terminate your access to the Site or Service at any time, for any reason or no reason, with or without notice. Without limiting the foregoing, YourPylon may terminate immediately upon determining that you have violated these Terms, provided false information, or engaged in conduct that threatens the integrity of the Service or the interests of third parties.

11.3 Effect of Termination

Upon termination for any reason: (a) your license to use the Site and Service ceases immediately; (b) YourPylon will cease submitting enrollment actions on your behalf; (c) YourPylon's data retention obligations as described in the Privacy Policy continue to apply. Sections 6, 7, 8, 9, 10, 11.3, and 12 survive termination indefinitely.

12. General Provisions

12.1 Entire Agreement

These Terms, together with the Privacy Policy and your signed Letter of Authorization, constitute the entire agreement between you and YourPylon with respect to the Service and supersede all prior or contemporaneous communications, representations, agreements, and understandings, whether written or oral.

12.2 Amendments

YourPylon may modify these Terms at any time by posting revised Terms on the Site. The revised Terms become effective upon posting. Your continued use of the Service after the revised Terms are posted constitutes your acceptance of the changes. It is your responsibility to check these Terms periodically. If you do not agree to revised Terms, you must stop using the Service immediately.

12.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or modified to the minimum extent necessary to make it enforceable. The remaining provisions will continue in full force and effect.

12.4 No Waiver

YourPylon's failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver must be explicit and in writing.

12.5 Assignment

You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without YourPylon's prior written consent. YourPylon may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets, without notice to you.

12.6 No Third-Party Beneficiaries

These Terms are for the exclusive benefit of the parties and do not create any rights in or for any third party.

12.7 Force Majeure

YourPylon will not be liable for any failure or delay in performance due to causes outside its reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, government actions, power failures, internet outages, or third-party service failures.

12.8 Relationship of the Parties

These Terms do not create any partnership, joint venture, employment, or franchise relationship between you and YourPylon. YourPylon is an independent contractor acting as your limited agent solely for electricity supplier selection purposes.

12.9 Notices

Notices to YourPylon must be sent to support@yourpylon.com. Notices to you will be sent to the email address on your account. You are responsible for keeping your email address current. Notice is deemed given when sent.
